About These Terms

These Terms and Conditions govern your purchase of products and use of materials provided by SavoirClair. Please read them before completing a purchase. By purchasing a SavoirClair product, you agree to these Terms.

These Terms are written in plain English. Where we have used legal language, it is because the substance requires it — not for its own sake.

These Terms should be read alongside:

  • our Refunds & Returns page — which sets out our refund guarantee and how to claim it

  • our Disclaimer — which sets out the educational scope of SavoirClair's materials and the limits of our liability

  • our Privacy Statement — which explains how we collect, use, and protect your personal information

Who These Terms Apply To

These Terms apply to anyone who purchases a SavoirClair product or accesses SavoirClair materials. SavoirClair's products are designed for professionals — specifically senior leaders of organisations and the practitioners who work alongside them. Our products are not intended for personal, domestic, or household use.

You must be 18 or over to purchase from SavoirClair.

Our Products

At the date these Terms were last updated, SavoirClair offers:

SavoirClair Technology Supplier Red Flag Checklist — a digital product delivered as a professionally designed, immediately downloadable PDF. Currently provided at no cost.

SavoirClair Technology Contract Essentials Toolkit — a digital product delivered as a professionally designed, immediately downloadable PDF. Current price displayed at checkout. One-off purchase: no subscription, no automatic renewal.

As SavoirClair introduces additional products and services within the Framework — including training materials and a peer community — the applicable terms for each will be stated clearly at the point of purchase. These Terms will also be updated accordingly.

Purchasing & Payment

Purchases are made through SavoirClair's secure checkout pages. Payment is processed by PayPal (and from mid-2026, Stripe). SavoirClair does not store your payment card details.

Prices are displayed in pounds sterling (£). If you are purchasing from outside the United Kingdom, your payment provider will apply their prevailing exchange rate. Any currency conversion costs are your responsibility.

A purchase is complete when payment has been confirmed by our payment processor. You will receive an order confirmation by email.

Digital Delivery

SavoirClair’s digital products are delivered by download link, available immediately after your payment is confirmed.

It is your responsibility to ensure you can receive and open the download. If you experience any difficulty with your download, contact [email protected] and we'll resolve it promptly.

Your Right To Cancel — Digital Products

Under the UK Consumer Contracts Regulations 2013, you have the right to cancel a distance purchase within 14 days without giving a reason. However, where a digital product has been made available for download, this statutory cancellation right may no longer apply once you have accessed the download.

Our unconditional money-back guarantee — set out in full on our [Refunds & Returns page] — is more generous than the statutory position. It applies regardless of whether you have downloaded or used the Toolkit. If you are not satisfied, we'll refund you. No conditions.

Intellectual Property

All SavoirClair materials are the intellectual property of Lorraine Pestell trading as SavoirClair and are protected by copyright.

When you purchase a SavoirClair digital product, you receive a licence to use it for your own professional purposes. This licence belongs to you as the purchaser and is not transferable to third parties outside your organisation.

This licence permits you to:

  • use the product for your own professional purposes, individually or collaboratively with colleagues

  • share the product within your own organisation to support the decision, project, or matter it is designed to address

  • retain a copy for your organisation's internal records

This licence does not permit you to:

  • reproduce, copy, or distribute the product or any part of it to third parties outside your organisation

  • resell, relicense, or commercially exploit the products or any part of them

  • remove or obscure any SavoirClair branding, authorship, or copyright notices

Educational Scope and Limitation of Liability

SavoirClair's materials are educational in nature. They do not constitute legal advice, technology consulting, regulated financial advice, or any other regulated professional advice. The full scope of this is set out in our Disclaimer, which forms part of these Terms by reference.

Nothing in these Terms limits or excludes our liability for:

  • death or personal injury caused by our negligence

  • fraud or fraudulent misrepresentation

  • any liability that cannot lawfully be excluded under applicable consumer protection legislation

Subject to the above, and to the fullest extent permitted by law, SavoirClair's total liability to you in connection with any purchase shall not exceed the amount you paid for the product giving rise to the claim.

We are not liable for indirect or consequential losses, including loss of profit, loss of business, or loss of anticipated savings — provided that this limitation is reasonable in the context of an educational product purchased for professional use.

Your statutory rights as a consumer in your legal jurisdiction are not affected by these Terms.

Accuracy of Materials

SavoirClair takes care to ensure that its materials reflect current best practice at the time of publication. We make no warranty that any specific material reflects the most current legal, regulatory, or technical position at the moment you use it. Technology, regulation, and commercial practice evolve, and our materials are updated periodically but not continuously.

For decisions with significant legal or regulatory implications, always verify the current position with a qualified adviser.

Acceptable Use

You agree to use SavoirClair's materials lawfully and in good faith. You agree not to use them:

  • in any way that breaches applicable law or regulation

  • to misrepresent SavoirClair's materials as your own original work

  • in any way that is materially damaging to SavoirClair or Lorraine Pestell

  • to use SavoirClair's materials as the basis for advice, analysis, or recommendations provided to third parties in a professional or commercial capacity, without our prior written consentfgdfg

Termination

We may terminate this agreement and your access to ongoing SavoirClair services (including email communications, future product purchases, and community access where applicable) by written notice if:

  • you materially breach these Terms (including the Acceptable Use provisions)

  • you misrepresent SavoirClair's materials or engage in conduct that in any way materially damaging to SavoirClair or Lorraine Pestell

  • you engage in fraudulent or unlawful conduct in connection with your purchase or use of SavoirClair materials

Where reasonable in the circumstances, we will give you an opportunity to remedy the breach before terminating. For serious breaches, termination may be immediate.

On termination: your intellectual property licence to use SavoirClair materials ends; you will be removed from our email list; any access to future SavoirClair products or services is revoked. We will retain your purchase records as required by tax and accounting law (see our Privacy Statement for retention periods).

You may end your relationship with SavoirClair at any time by unsubscribing from our communications and, if you wish, requesting deletion of your personal data as described in our Privacy Statement. Termination by you does not entitle you to a refund of the purchase price — the refund guarantee is set out separately on our [Refunds and Returns page].

Changes To These Terms

We may update these Terms from time to time — for example, when we introduce new products or when applicable law changes. The version published on our website at the time of your purchase is the version that applies to that purchase. We will not apply updated Terms retrospectively to purchases already made.

When we make material changes, we will update the "Last updated" date at the top of this page. Where changes are material, we will notify existing customers by email.

Governing Law & Jurisdiction

These Terms are governed by the law of England and Wales.

Any dispute arising from these Terms or from a purchase made under them will be subject to the exclusive jurisdiction of the courts of England and Wales, except that:

  • if you are resident in Scotland, Northern Ireland, or another UK nation, you may bring proceedings in your local courts

  • if you are resident outside the United Kingdom, nothing in these Terms affects your rights under the mandatory consumer protection laws of your own jurisdiction

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force and effect.
